PLEASE READ CAREFULLY

• The terms "we", "us", "our" “Elmadina Travel” and "ET" refer to Elmadina Travel, CORP., a New York corporation, its subsidiaries and affiliates. The term "you" refers to the customer visiting the Website and/or booking a reservation either through us on the Website or through our customer service agents. The term “Website” refers to the Elmadina Travel website. The term “Agreement” or “Terms & Conditions” refer to all the terms, conditions, and notices set forth below. By booking any travel products or services, or accessing or using the Website or promotional materials in any manner you agree to be bound by this Agreement. Please read the Agreement carefully. If you do not accept all of these terms and conditions, please do not make bookings through our customer service agents or through the Website, and please do not use the Website. Be sure to return to website periodically to review the most current version of the Agreement. We reserve the right at any time, at our sole discretion, to change or otherwise modify the Agreement without prior notice, and your continued access or use of our services or the Website signifies your acceptance of the updated or modified Agreement.

1- Elmadina Travel Services:

• The Responsibility of Elmadina Travel, 24-18 Steinway St, Astoria, NY 11103, acts as agents and protector for the passengers' rights in making arrangements for the airlines, hotels, buses, or any service in connection with the tour and assumes no liability whatsoever for injury, damage, loss, luggage, accidents, delay irregularity which may be occasioned either by reason or defect, though the acts of Allah, dangerous incidents in the air, sea, land, fire, breakdown of machinery or equipment, acts of government or other authorities de jure or de facto, wars, whether declared or not, hostilities, civil disturbances, strikes, riots theft, pilferage, epidemics, quarantines, medical or customs regulations, or from any loss or damage resulting from improper passports, visas, or other documents.
• Elmadina Travel is not responsible for loss or additional expenses due to delay or changes in schedule or other causes.
• Elmadina Travel is not liable or responsible for any inconvenience, loss, damage or injury arising in connection with such service.
• Elmadina Travel is not responsible for the failure to follow instructions, including but not limited to check-in and delay, loss of luggage or personal belongings (Medicine). It is the responsibility of the airline to determine exactly what procedure will be followed. The policy chosen by that carrier shall be based on their procedure and shall not be the responsibility of Elmadina Travel and its affiliates. They will also not be responsible for any person(s) missing and part of the program due to his negligence or delay or absenteeism for any time during the tour and will not be responsible for any additional expenses for the participant to rejoin the tour. Moreover, no charges or upgrades in the program chosen will be the honored after departure as well as no refund will be given for any services rendered not utilized.
• Elmadina Travel has no control and is not responsible for any additional expenses, delays, omissions, re-routing, or acts of interference by any government or legal authorities, including but not limited to, government changes in the dates of the Islamic (‘Hijri’) calendar. I explicitly understand that the Islamic (‘Hijri’) Calendar may change relative to the Gregorian calendar, which may affect my hotel, flight, and other travel accommodations, and I do not hold ET or any of its representatives liable for any such change(s), or any impact that such change(s) may have upon my pilgrimage or its integrals.
• Elmadina Travel will choose and designate an airline carrier as the packages are FIT. The airline chosen by the ET agent will be the sole discretion of the operator as it will be slotted according to the agent’s package and accommodation schedule for arrival and departures in the Kingdom.

2. Fitness & Health

• Please be aware that during your participation in packages operated by Elmadina travel, certain aspects of the tour package will be physically demanding and require a certain level of physical fitness to be able to fully participate. You agree that you are physically fit to travel and participate in the packages operated by Elmadina travel, and that it is your responsibility to research all package destination(s), and the included activities, to determine whether you are physically fit and able enough to participate at the level required by the tour. You hold harmless ET and agree that ET shall have no liability regarding any portion of the tour that you are unable to participate in due to your health and/or fitness level. ET will not have liability regarding access to or provision of medical care or the adequacy of any care that may be rendered.

3. Deposit / Fees Policy:

• An initial deposit of $3,000.00 each is required for reservation and Full payment is due by Ramadan 1 every year.
• Your booking is not confirmed until your registration/application is approved by ET at its sole discretion, the Deposit is received by ET and you receive written confirmation of your booking from ET. Your reservation may be automatically canceled if payments are not received by ET by the applicable deadlines above. Special conditions may apply to the prices set out on the Website. To determine such conditions, you must contact ET. Please review and verify your booking invoice thoroughly and contact ET immediately if your invoice appears to be incorrect or incomplete.
• Please be advised that once your visa has been processed, there will be NO refunds available for the package(s) you have purchased.
• All fees imposed by the Kingdom of Saudi Arabia, including Hajj and Umrah fees or related to the ritual animal sacrifice, are separately charged and not included in any package or programs.
• Please be advised Elmadina Travel, in its sole discretion, may, at any time and without advance notice or liability reserves the right to reject/refuse/cancel any application for any reason at any time prior to departure.

4. Cancellation Policy:

• Prepaid packages, high-season packages, and customized packages are non-refundable. For all travel and tour packages, including Hajj and Umrah, all cancellation requests must be received by ET in writing. You acknowledge and understand that ET incurs significant expenses and losses if a traveler cancels a booking. You expressly understand that the following cancellation fees will apply and be strictly adhered to by ET:
• (a) Cancellation Made 120 days prior to the travel date: $300.00 per person cancellation fee
• (b) Cancellation made 90 to 120 days prior to the travel date : $500.00 per person cancellation fee
• (c) Cancellation made less than 90 days prior to the travel date : No-refund will be provided on any reservation
• In addition to the above-noted cancellation fees, airfare purchases are nonrefundable and any such amounts shall not be reimbursed to any traveler canceling a booking.
• After Hajj visa is issued, NO refund will be given.

5. Travelers Who Need Special Assistance:

• You must report to ET in writing any disability requiring special attention while traveling at the time the reservation is made. ET will make reasonable attempts to accommodate the special needs of disabled travelers, but is not responsible in the event it is unable to do so nor is it responsible for any denial of services by Service Providers. ET regrets that ET cannot provide individual assistance to a traveler for walking, dining, getting on and off buses and other vehicles, or other personal needs. A qualified and physically able companion must accompany travelers who need such assistance and must assume full responsibility for their well-being; if such a companion is not available for the traveler, ET may, in its discretion, cancel the reservation and return the full deposit of the traveler. ET accepts no liability or responsibility for any traveler who needs such assistance but does not have a qualified and physically able companion.

BY SIGNING BELOW, CLICKING THE REGISTER BUTTON ON THE WEBSITE, ACCEPTING SERVICES FROM ELMADINA TRAVEL, OR BY NOT CANCELING THE RESERVATION WITH ET, YOU, THE TRAVELER OR ARRANGER, CONFIRM THAT YOU HAVE READ AND AGREE TO THE TERMS & CONDITIONS ABOVE. YOU ALSO ACKNOWLEDGE THAT YOU FULLY UNDERSTAND THE PACKAGE WHICH YOU ARE PURCHASING AND ALL TERMS & CONDITIONS THAT APPLY. YOU ALSO ACKNOWLEDGE THAT, IN THE EVENT YOU ARE MAKING A RESERVATION ON BEHALF OF ANOTHER TRAVELER, YOU ARE AUTHORIZED TO BIND THE OTHER TRAVELER TO THESE TERMS & CONDITIONS AND THAT YOU HAVE SO INFORMED THAT TRAVELER OF THESE TERMS & CONDITIONS.
